Welcome to Recess, provided by Collaboration Studios, Inc. We offer enriching educational experiences in gaming environments, tailored for children's learning and social interaction. Your use of Recess constitutes agreement to these legally binding terms.

2. User Responsibilities

Users of Recess are expected to engage respectfully and responsibly on the platform. Prohibited behaviors include cyberbullying, the use of inappropriate language, sharing offensive content, and any other activities that disrupt the safe and positive environment we strive to maintain. Users are encouraged to use the provided mechanisms for reporting any concerns or violations.

3. Payment and Subscription Terms

Payments are processed monthly via credit card through Stripe. Refund requests will be considered on a case-by-case basis and can be made through the app or by contacting [email protected]. Detailed information on subscription management and cancellation is available in the user account settings.

4. Intellectual Property Rights

Recess owns all rights to its proprietary content. For user-generated content (UGC), users retain their rights, but grant Recess the right to use such content in a non-identifiable manner, ensuring it does not reveal the user's identity. This includes modifying, reproducing, and distributing the content for Recess’s operational purposes.

5. Account Termination and Suspension

Recess reserves the right to terminate or suspend accounts for reasons including but not limited to service abuse, harassment, or any illegal activities. Users will be notified of such actions and provided with relevant information.

6. Modifications to Terms and Conditions

Recess may modify these Terms and Conditions, with users being notified at least 30 days in advance of any changes via email. Continued use of the service after changes signifies acceptance of the revised terms.

8. Disclaimer and Limitation of Liability

Recess is provided without warranties of any kind. The company’s liability is limited to the fullest extent permitted by law. This limitation applies to any damages arising from the use of the service, including but not limited to indirect, incidental, or consequential damages.

9. Governing Law

The Terms and Conditions are governed by the laws of the State of California, USA. This jurisdiction applies regardless of the geographical location of the user.

10. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be in full effect. These Terms constitute the entire agreement between Recess and its users.

11. Compliance with COPPA and GDPR

In accordance with COPPA, we collect personal information from children under 13 only with verifiable parental consent. Under GDPR, users can request access to, rectification of, or deletion of their personal data by contacting us directly.

12. Arbitration Clause

  • Disputes arising from these Terms will be resolved through binding arbitration, conducted under the rules of the American Arbitration Association.

  • Arbitration will take place in English, in San Francisco, California, unless otherwise agreed.

  • The arbitrator's decision will be final and binding, enforceable in any court of competent jurisdiction.

  • Users waive their right to a jury trial and agree to resolve disputes exclusively through arbitration.
